Terms governing the use of the ChooseIT app

ChooseIT was created to make gifting simpler: the sender can suggest several options and let the recipient choose the one they prefer. These Terms explain the essential rules for using the service.
ChooseIT is a free service operated by ChooseIT Suisse di Stefano Brolis, CHE-334.593.338, Via Franco Zorzi 13, 6900 Paradiso, Switzerland.
ChooseIT allows users to browse products available in the app, save them, create gift lists or requests for advice and share them with other people. By using the service, you agree to these Terms.
Several features can be used without registering. If an account is created, the user is responsible for the accuracy of the information provided and for keeping their login credentials secure.
Users must be at least 16 years old to create an account independently.
The sender can select several products, add a message or gift note and share the list using the sharing options available on their device.
The recipient can open the link without installing ChooseIT or creating an account, view the suggested products and choose the one they prefer. Where applicable, the recipient can also select a size, color or another available variant.
The recipient's choice does not constitute an order or purchase. It simply tells the sender which option was preferred. Any purchase is made later by the sender directly from the retailer.
ChooseIT can also be used to share a selection of products and ask another person which one they prefer, without the selection necessarily being a gift. In this mode, certain information, including the price, may be shown to the recipient.
ChooseIT does not sell the products displayed in the app and does not handle payments, payment information, invoicing, shipping, warranties, exchanges, returns or refunds.
When a user decides to make a purchase, they are redirected to the website or service of the relevant brand or retailer. The sale is concluded exclusively between the purchaser and the retailer and is subject to the retailer's terms and conditions of sale.
Product information is provided by brands, retailers, product feeds, APIs or other sources used by ChooseIT. We take reasonable steps to keep this information up to date, but prices, availability, images, sizes, colors and other product details may change.
The price, availability and terms shown by the retailer at the time of purchase always prevail. Any shipping costs, taxes, duties or other charges are determined by the retailer.
ChooseIT does not guarantee that a product selected when a list is created will still be available when the recipient makes a choice or when the sender completes the purchase.
ChooseIT may receive a commission when a purchase is completed through a link to a brand, retailer or affiliate partner. This commission does not change the price paid by the user.
The order and visibility of products may depend on factors such as newness, availability, editorial choices and commercial or strategic relationships with brands and retailers, including affiliate terms. Content that is specifically sponsored will be identified where required by applicable law.
ChooseIT may allow users to select a contact through the device's native contact picker without automatically importing the entire address book. Users are responsible for using information relating to other people lawfully and consistently with the personal nature of the service.
Users may add messages or gift notes. ChooseIT must not be used to share unlawful, fraudulent, offensive content or content that infringes the rights of others.
Sharing through WhatsApp, email, SMS, social networks or other services takes place through third-party tools and is subject to their own terms and privacy policies. Any sharing on social media is always optional.
The ChooseIT software, design, trademark and original content belong to ChooseIT or its licensors.
Trademarks, images, descriptions and other materials relating to products belong to their respective brands, retailers or rights holders. The presence of a product in the app does not transfer any rights in that product or trademark to ChooseIT.
ChooseIT aims to keep the service current, secure and available, but cannot guarantee that it will always be free from interruptions, technical errors or changes in information received from third parties.
ChooseIT is responsible for the services it provides directly to the extent required by law, but is not responsible for the performance of sales contracts entered into with retailers or for issues relating to products, payments, deliveries, warranties, exchanges or returns handled by third parties.
Nothing in these Terms excludes or limits rights or liabilities that cannot be excluded under applicable law, including mandatory consumer rights.
Registered users can delete their account directly from their profile. Deleting an account removes the account and the associated data, including lists, stored information and notifications, except for any information that must be retained by law.

ChooseIT may update the service and these Terms when necessary. Material changes will be communicated where required by applicable law.
These Terms are governed by Swiss law. If you are a consumer resident in another country, this choice does not affect any mandatory consumer protections that apply under the law of your country of residence.
